Hemp is subject to narcotics legislation only when the combined concentration of Δ9-THC (delta-9 tetrahydrocannabinol) exceeds 0.3%.
Below this threshold, the product cannot be considered psychoactive, but rather an industrial-use product (notably textile hemp), the cultivation of which is authorized and even subsidized (see Council Regulation (EC) No. 1672/2000 of July 27, 2000 amending Regulation (EC) No. 1251/1999 establishing a support system for producers of certain arable crops, to include flax and hemp grown for fiber production).
The hemp varieties cultivated must appear on the exhaustive list set out in Article 2 of the Order of August 22, 1990.
Can we export to all countries of the European Union?
European Union law establishes a common organization of markets for certain agricultural products. Among these products are hemp varieties (Cannabis sativa L.) listed in the EU Common Catalogue of Agricultural Plant Species. The agricultural production, trade, and industrial use of these products are authorized under European law provided that their delta-9 tetrahydrocannabinol (THC) content does not exceed 0.3%.
The Treaty on the Functioning of the European Union establishes the principle of the free movement of goods (Articles 34 to 37), which includes agricultural products and products of primary processing (Article 38) listed in Annex I of the Treaty. Annex I, Chapter 57, refers to “raw hemp (Cannabis sativa), retted, scutched, hackled or otherwise processed but not spun; tow and waste (including yarn waste).”
Thus, European law imposes no restriction on which part of the plant may be produced and marketed. The only possible restriction by Member States relates to risks to human health. The hemp flower must be considered an agricultural product since it is raw. The delta-9 tetrahydrocannabinol (THC) level therefore remains the sole factor taken into account for an official and legal determination before any court.
